Terms / 8 September 2026
Terms of use and software licence.
A material later change will be notified and presented for acceptance where the law requires it; it will not operate retroactively.
1. Seller and contract
cinemaOS is supplied by Julien Kerknawi, trading as Momentum Studios, a Belgian sole trader, enterprise number 0648.946.826, VAT BE0648946826 (“Momentum”, “we”, “us”). Registered establishment: Jules Van Biesbroeckstraat 156, 9050 Gent, Belgium. Contact: support@mntm-studios.com.
These terms govern the cinemaOS application, Momentum account, updates, support, trial and paid subscriptions. You must be at least 18 and legally able to contract. The order summary, plan and price shown at checkout form part of the contract.
2. Service and disclosed Beta 2 limits
cinemaOS is professional macOS post-production software for Apple Silicon Macs running macOS 15 or later. Its bundled AI and media analysis run locally. Momentum does not receive your projects, footage, frames, transcripts, prompts or model output for those features and does not train models on them. Optional restoration packs are downloaded only when requested.
Beta 2 is pre-release software. Functions may change and defects may remain. Voice cloning is not supplied in this build. Automated lip sync, DCP and IMF authoring, Dolby E-AC-3 JOC and AC-4 encoding, and vendor RAW SDKs for R3D, BRAW, ARRIRAW and X-OCN are not included. Interchange import is conform-grade, not parity-complete. Local dubbing and translation depend on macOS resources installed on the Mac. Analysis and AI suggestions require professional review and are not certified measurement or creative truth.
These disclosed limits define the Beta 2 offering but do not exclude statutory conformity rights for paid software.
3. Accounts and trial
You must provide accurate information, protect your credentials and promptly report suspected compromise. You may not sell or share an account, evade device or trial controls, automate referrals, attack the service, or use it unlawfully.
- The Complete trial lasts 60 days from verified signup, needs no card, never auto-converts and never causes a charge.
- Valid independent referrals may extend a trial by 14 days for the new account. The person who shared the code may receive the same 14 days at most twice (28 extra days). Duplicate, self, automated, shared-device or fraudulent rewards may be refused or reversed.
4. Plans, tax and payment
Complete, which includes J.A.R.E.D., costs €9.99 / $9.99 per month excluding VAT. Teams is billed per seat at €8.99 / $8.99 excluding VAT, with a minimum of two seats and a maximum of fifty. Applicable VAT is calculated from the required billing address and added at checkout. The total is displayed before payment. Eligible businesses may provide a valid VAT number for reverse charge or exemption treatment.
Stripe processes payment details; Momentum does not store full card numbers. A subscription begins only when you choose a plan and complete checkout. It renews monthly at the then-current price plus tax until cancelled. We will give advance notice of a price increase before it affects a renewal.
5. Cancellation, failed payment and access
You can cancel at any time without a fee through the Stripe-hosted billing portal or by emailing support. Unless a statutory withdrawal or remedy applies, cancellation stops the next renewal and access continues to the end of the paid period. Confirmed payment failure, fraud, material breach or a security risk may result in proportionate suspension. You may appeal to support.
One account may activate two Macs. Offline entitlement lasts at most seven days and never beyond the underlying access period. Expiry or suspension does not permit Momentum to encrypt, delete or hold your projects hostage: opening, saving, backup, relink, recovery, local diagnostics and cancellation remain available.
6. EU consumer withdrawal
An EU consumer may withdraw from a paid subscription within 14 days of completing checkout without giving a reason. Send an unequivocal statement to support@mntm-studios.com before the period expires. We will refund amounts due, including corresponding VAT, through the original payment method without undue delay and no later than 14 days after notice.
Paid access starts immediately. If checkout separately records your express request for performance during the withdrawal period, a lawful proportionate amount may be payable for service supplied before withdrawal. Momentum will rely on a loss of the withdrawal right for digital content or services only where checkout separately captures the prior express consent and acknowledgement required by applicable law; use or download alone is not treated as a waiver.
7. Refund policy
Refunds are provided where required by withdrawal, conformity, billing-error or other mandatory law. Outside those cases, Momentum offers no contractual or automatic refund after a paid period has begun. Momentum may grant a discretionary goodwill credit or refund; doing so creates no continuing policy, precedent, admission or obligation to do so again.
8. Licence, ownership and acceptable use
While entitled, you receive a limited, non-exclusive, non-transferable licence to install and use cinemaOS for lawful personal or commercial creative work. You may not redistribute or rent the software, bypass controls, extract or misuse keys, reverse engineer except where law expressly permits it, infringe third-party rights, or use the service to cause harm.
You own your projects, source media and output. Momentum claims no licence over them. You are responsible for having necessary rights, maintaining independent backups and checking all automated or AI-assisted results before delivery.
9. Updates and availability
Updates are cryptographically signed. Beta features may be added, changed or removed, and compatibility can require a minimum build for new entitlements. We will provide updates required by mandatory conformity law. Account, email, billing and update infrastructure may be unavailable for maintenance, security incidents, provider outages or events beyond reasonable control.
10. Warranty and remedies
Consumers retain every mandatory Belgian and EU conformity remedy, potentially including repair or update, proportionate price reduction, or termination and refund. These rights are free and are not reduced by Beta status.
To the maximum extent lawful, Beta 2 and its non-mandatory services are otherwise supplied “as available”. Momentum does not promise uninterrupted or error-free operation, compatibility with every media file or third-party system, preservation of unsaved work, or that automated output is suitable for broadcast, delivery, legal, medical, safety-critical or other regulated use.
11. Liability allocation
Nothing excludes liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory consumer remedies.
For a consumer, Momentum is responsible only to the extent and within the limits permitted by mandatory law. Momentum is not responsible for loss that was not reasonably foreseeable when the contract was made, or for business loss arising from a consumer’s non-business use.
For a professional or business customer, to the maximum extent permitted by law: Momentum is not liable for indirect or consequential loss, lost profit, revenue, opportunity, goodwill, contracts, anticipated savings, production delay, client claims, or loss or corruption of data that an appropriate backup would have prevented; and Momentum’s aggregate liability arising from Beta 2 during any rolling 12-month period is capped at the fees that customer actually paid to Momentum for cinemaOS during that period.
A professional customer will defend and indemnify Momentum against a third-party claim arising from that customer’s unlawful content, infringement of third-party rights, or material breach of section 8, except to the extent caused by Momentum. This indemnity does not apply to consumers acting outside a trade or profession.
12. Force majeure
Neither party is liable for delay or failure caused by circumstances beyond reasonable control, including widespread network or cloud failure, government action, labour disruption, natural disaster, war, epidemic or failure of essential third-party infrastructure. This does not excuse payment already due or prevent a consumer exercising mandatory termination rights.
13. Termination and survival
We may terminate for an uncured material breach after reasonable notice, or immediately for fraud, unlawful conduct or an urgent security threat. Provisions concerning ownership, payment already due, liability, indemnity, governing law and dispute resolution survive. Account deletion does not itself cancel a Stripe subscription; ask support to perform both or cancel first in the billing portal.
14. Governing law and disputes
Belgian law applies, without depriving a consumer of mandatory protection or venue in the consumer’s country of residence. Courts in Ghent, Belgium have jurisdiction for professional customers, subject to mandatory law.
Please first send a written complaint to support so we can try to resolve it. A Belgian consumer may then contact the independent Consumer Mediation Service, North Gate II, Boulevard du Roi Albert II 8 bte 1, 1000 Brussels, Belgium, contact@consumerombudsman.be, consumerombudsman.be. The former EU Online Dispute Resolution platform was discontinued on 20 July 2025.
